This Privacy Policy describes how ConcertMosh, Inc. ("Mosh," "we," "us," or "our") collects, uses, and shares information about you when you use the Mosh mobile application (the "App") available on iOS and Android. By using Mosh, you agree to the practices described in this Privacy Policy.

1.1 Information You Provide

When you create an account or use the App, you may provide us with:

  • Account data, such as your name, username, email address, and password.
  • Profile data, such as your profile photo and biography.
  • User-generated content, including photos and videos you upload or share within the App.

1.2 Location Data

With your permission, we collect precise geolocation data from your device to help you discover and search for concert venues near you. You may disable location access at any time through your device settings; however, certain venue discovery features may not function without it.

When you use the App, we and our service providers may automatically collect:

  • Device data, such as your device type, operating system version, unique device identifiers, and IP address.
  • Usage data, such as the pages or features you access, time spent in the App, and crash reports.
  • Log data, including access times, error logs, and performance data used to maintain and improve the App.

  • Provide, operate, and improve the Mosh App and its features.
  • Enable you to create a profile, upload content, and connect with other users.
  • Use your location data to power venue search and discovery features.

  • Detect, prevent, and address fraud, abuse, or security incidents.

How We Share Your Information

3.1 With Other Users

Certain profile information and user-generated content (photos and videos) may be visible to other registered users of the App. If you set your profile to public, your content and profile details may be viewable by all users. If you set your profile to private, only users you approve can view your content. You can manage your privacy settings at any time from within the App.

3.2 We Do Not Sell Your Data

We do not sell, rent, or share your personal information with third parties for their own marketing or advertising purposes.

3.3 Service Providers

We may share your information with trusted third-party service providers who assist us in operating the App (e.g., cloud hosting, analytics, customer support). These providers are contractually obligated to use your data only to perform services on our behalf and in accordance with this Privacy Policy.

3.4 Legal Requirements and Protection

We may disclose your information when we believe in good faith that such disclosure is necessary to:

  • Comply with a legal obligation, court order, or government request.
  • Protect the rights, safety, or property of ConcertMosh, our users, or the public.

User-Generated Content

Photos and videos you post within the Mosh App are shared with other registered users of the platform according to your privacy settings (public or private profile). Please do not post content that includes sensitive personal information about yourself or others. Content you post may be retained even after you delete your account if it has been shared or interacted with by other users, except where deletion is required by applicable law.

Location Data

We collect precise location data solely to enable venue search and discovery features within the App. We do not use your location data for advertising purposes. You can revoke location permissions at any time in your device settings (iOS: Settings > Privacy > Location Services; Android: Settings > Apps > Mosh > Permissions).

Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the App's services. If you delete your account, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law, to resolve disputes, or to enforce our agreements.

Your Choices and Rights

7.1 Account and Data Deletion

You may delete your account and associated data at any time directly within the App. Once deleted, your account and personal information will be removed in accordance with our data retention practices described above.

7.2 Profile Privacy

You can toggle your profile between public and private at any time from your account settings within the App.

7.3 Location Permissions

You can enable or disable location access for Mosh at any time through your device's operating system settings.

7.4 Communications

You may opt out of non-essential communications from us by following the unsubscribe instructions in any email we send, or by contacting us at support@mosh.live.

7.5 California Residents (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to:

  • Know what personal information we collect, use, and disclose about you.
  • Request deletion of your personal information (subject to certain exceptions).
  • Opt out of the sale of your personal information. Note: We do not sell your personal information.
  • Non-discrimination for exercising your privacy rights.

Children's Privacy

Mosh is intended for users who are 13 years of age or older. We do not knowingly collect personal information from children under the age of 13. If we become aware that a child under 13 has provided us with personal information without verifiable parental consent, we will take steps to delete such information as required by the Children's Online Privacy Protection Act (COPPA).

If you are a parent or guardian and believe your child under 13 has used the App or provided us with personal information, please contact us immediately at support@mosh.live.

Security

We implement reasonable technical and organizational safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee the absolute security of your information and encourage you to use a strong, unique password for your account.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the effective date at the top of this policy and, where appropriate, by providing notice within the App or via email. Your continued use of the App after any changes become effective constitutes your acceptance of the updated Privacy Policy.
